Data Processing Agreement (DPA)

This Data Processing Agreement forms part of the agreement between The Property Consultancy Group Limited and the Customer where personal data is processed through the Follow My Lead platform.

The Customer is the Data Controller. The Property Consultancy Group Limited acts as the Data Processor when processing personal data on behalf of the Customer.

Follow My Lead processes personal data only to provide the platform, host customer information, provide support, maintain security and deliver agreed functionality.

Examples include client names, contact details, property information, introducer details, adviser information, case notes and other information uploaded by authorised users.

The Customer confirms it has a lawful basis for processing personal data, has provided any required privacy notices and will comply with UK GDPR and other applicable legislation.

We will only process personal data in accordance with documented instructions, maintain confidentiality, implement appropriate technical and organisational security measures and assist the Customer where reasonably required.

We maintain appropriate administrative, technical and organisational safeguards designed to protect personal data against unauthorised access, loss, misuse or disclosure.

We may use carefully selected third-party service providers where necessary to operate the platform. Where required, appropriate contractual safeguards will be in place.

If we become aware of a personal data breach affecting Customer data, we will notify the Customer without undue delay and provide reasonable assistance.

Following termination of the subscription, Customer data will normally be retained for up to 90 days before secure deletion unless retention is required by law or requested otherwise.

Personal data will not be transferred outside the UK unless appropriate legal safeguards are in place or the Customer instructs otherwise.

Where reasonably requested, we will provide information demonstrating compliance with our obligations under this DPA, subject to confidentiality and security requirements.

This Agreement is governed by the laws of England and Wales.
